Please read these Terms of Use ("Terms") carefully before using the Pausa mobile application (the "Service") operated by Pausa ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. IMPORTANT: Medical Disclaimer

The Service offers health, wellness, and fitness information and is designed for educational and entertainment purposes only. You should not rely on this information as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment.

  • Consult Your Doctor: If you have any concerns or questions about your health, you should always consult with a physician or other health-care professional. Do not disregard, avoid, or delay obtaining medical or health-related advice from your health-care professional because of something you may have read or seen on the Service.

  • Assume All Risk: The use of any information provided on the Service is solely at your own risk. Physical exercise can be a strenuous activity. You are responsible for exercising within your limits and assuming all risk of injury to your person or property.

  • Not a Medical Device: Pausa is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

2. The Service

Pausa provides users with a library of guided exercises, routines, and wellness content designed to be performed during breaks in a sedentary workday. The Service includes predefined routines, a personalization engine to create tailored plans, and tools for users to create their own custom routines.

3. Subscriptions ("Pausa Plus")

Certain features of the Service may be subject to payments now or in the future ("Paid Services").

  • Billing: Pausa Plus subscriptions are billed on a subscription basis (e.g., monthly or yearly). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Your subscription will automatically renew at the end of each Billing Cycle unless you cancel it.

  • Payment Processing: All payments are processed through the Apple App Store or Google Play Store ("App Stores"). You must provide the respective App Store with a valid payment method. We do not collect or store your payment card details.

  • Cancellations: You may cancel your subscription renewal at any time through your account settings in the App Store. You will continue to have access to the Paid Services until the end of your current Billing Cycle.

  • Fee Changes: We reserve the right to change our subscription fees at any time. Any fee change will become effective at the end of the then-current Billing Cycle. We will provide you with reasonable prior notice of any change in subscription fees to give you an opportunity to terminate your subscription before such change becomes effective.

  • Refunds: Except when required by law, paid subscription fees are non-refundable.

4. User-Created Content ("Custom Routines")

The Service allows you to create your own custom routines, including names and descriptions ("User Content"). All User Content is stored locally on your device. You are solely responsible for the User Content you create. You agree that you will not create any User Content that is unlawful, offensive, or otherwise objectionable. We reserve the right, but not the obligation, to remove any User Content at our sole discretion.

5. License to Use the Service

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with these Terms. You agree not to, and you will not permit others to:
a) License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Service.
b) Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Service.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of [Your Company Name] and its licensors. The Service is protected by copyright, trademark, and other laws of [Your Country] and foreign countries. Our trademarks may not be used in connection with any product or service without our prior written consent.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9. Limitation of Liability

IN NO EVENT SHALL PAUSA, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Poland, Pausa, without regard to its conflict of law provisions.

11. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
